Municipal Consent
Municipal Consent to install or move utilities
Municipal Consent approval gives utility providers permission to install or move utility infrastructure within the Region's right-of-way. Municipal Consent grants approval for the location of the plant within the right-of-way. A Road Occupancy Permit is also required to undertake the work.
Eligibility
Municipal Consents will only be granted to:
- Utility companies
- Commissions
- Agencies
- Municipalities
- Private applications (who have a Municipal Access Agreement with the Region of Durham)

Our Works Department's Municipal Consent Application Requirements Guideline must be followed when submitting an application.
Separate applications are required for projects that involve work at more than one location. Also, separate MC applications are required for each individual Regional road that you are proposing to build on.
It is strongly encouraged that all Municipal Consent application drawing illustrate existing utility infrastructure to ensure all existing infrastructure is considered in your design. Regional utility information can be obtained by submitting a request for as-built drawings here. Utility record information must be obtained by submitting requests to each individual utility company.
Please apply at least 60 days before the planned start of the work. The official application date is the date that the Region of Durham receives the application. Municipal Consent approval is valid for one year. If the work is not constructed within one year of approval, a request for an extension must be made to the Region's approver. A Municipal Consent fee of $700 plus HST per application will be invoiced after approval.
As of January 1st 2025, the Region's Municipal Consent fee structure has been revised to the following:
- 20m or less of proposed infrastructure - $305 plus HST per application
- Greater than 20m of proposed infrastructure - $850 base fee +$1/m of infrastructure
- Forced relocations to accommodate Region projects - no fee
